Terms of service

  1. Definitions
    1. Terms and Conditions – these Terms and Conditions, defining the rules for concluding distance sales contracts via the Online Store, the rules for executing these contracts, the rights and obligations of the parties to the Distance Sales Contract, and complaint procedure rules. Regarding services provided electronically, the Terms and Conditions serve as the regulations referred to in Art. 8 of the Act on Providing Services by Electronic Means.
    2. Customer – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality granted legal capacity by law, who enters into a Distance Sales Contract with the Seller.
    3. Consumer – a consumer within the meaning of Art. 22 1 of the Civil Code. According to the statutory definition: a Consumer is a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity.
    4. Sole Proprietor purchasing for non-professional purposes - a natural person concluding a Distance Sales Contract directly related to their business activity, when the content of this contract shows that it does not have a professional nature for this person, resulting in particular from the subject of their business activity made available under the provisions on the Central Register and Information on Economic Activity, granted the right to: withdraw from the contract under terms granted to Consumers, the application of provisions on unlawful terms used in standard contracts, and statutory warranty liability for defects in sold goods.

    7. Online Store – an online service operated by the Seller, available at:https://tuyapolska.pl/ , through which the Customer can obtain information about Goods and their availability and buy Goods or commission a service.
    8. Distance Sales Contract – a contract for the sale of Goods/provision of services/delivery of digital content (if applicable), concluded through the Online Store.
    9. Goods – a movable item that the Customer can purchase in the Online Store.
    10. Privacy and Cookies Policy of the Online Store – a document defining detailed rules for personal data processing and the use of cookies. The Privacy and Cookies Policy is available at https://tuyapolska.pl/policies/privacy-policy.
    11. Durable Medium – means any instrument or tool enabling the Customer or the Seller to store information addressed personally to them in a way accessible for future reference for a period of time adequate for the purposes of the information and which allows the unchanged reproduction of the stored information, in particular email.
    12. Electronic Order Form – an electronic ordering procedure provided by the Seller for the Buyer.
    13. Placing an Order – confirming the order by clicking the "Order and Pay" button, treated as submitting a binding statement of intent by the Customer to conclude a Distance Sales Contract with the Seller.
    14. Account – a set of data stored in the Online Store and in the Seller's ICT system regarding a given Customer and their orders and concluded Distance Sales Contracts, using which the Customer can place orders, as well as cancel, edit, and conclude Distance Sales Contracts in due time.
    15. Order Rating and Individual Item Rating – subjective statements and ratings given by the Customer in the form of 1 to 5 stars for the Online Store after a completed Order.
  2. General Provisions
    1. Types and scope of services provided electronically:
      1. concluding online Sales Contracts – regarding Goods sold in the Online Store,
      2. rules for registration and use of the Account within the Online Store,
      3. adding reviews, comments, and ratings – the Customer can add a review or comment to their order,
      4. sending email messages in which the Seller confirms receipt of the order, payment confirmation, and order processing acceptance.
    2. Using the Online Store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
      1. web browsers such as Firefox, Chrome, Internet Explorer in current versions,
      2. any software for viewing PDF files.
    3. The content posted on the Online Store pages, including Goods descriptions and prices, constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code. They become binding – for the purpose of concluding a specific contract – only upon sending the order by the Customer, which occurs by clicking the "Order and Pay" button.
    4. The Seller provides these Terms and Conditions together with Annexes via a link on the main page prior to concluding the Distance Sales Contract, during its execution, and after completion. The Buyer can download and print them.
    5. To ensure the security of message and data transmission in connection with the services provided, the Online Store takes technical and organizational measures appropriate to the security degree of the provided services, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted over the Internet.
  3. Orders
    1. Orders in the Online Store can be placed through the Account or by selecting the purchase option without registration.
    2. Purchases are made by filling out the Electronic Order Form available on the Online Store website. The selection of ordered Goods is made by adding them to the cart. The Electronic Order Form specifies, among others, which Goods, at what price, and in what quantities the Customer wants to order to the indicated location. The Customer takes appropriate technical steps based on displayed messages.
    3. After entering all necessary data, a summary of the placed order will be displayed. The order summary will include information regarding: Seller's identification data, subject of the order, unit and total price of ordered Goods, including delivery costs and others if any, selected payment method, selected delivery method, delivery time, and costs.
    4. If the subject of the contract is the supply of digital content not saved on a tangible medium or services performed electronically or at a distance - the Consumer expresses the following consent in an additional checkbox required to place the order on the Electronic Order Form: "I consent to the supply of digital content not stored on a tangible medium or to the commencement of service performance before 14 days from the date of concluding the contract and acknowledge the loss of the right to withdraw from the contract". The Seller will confirm receipt of the above consent via email.
    5. To place an Order, it is necessary to provide personal data marked as mandatory in the Electronic Order Form, accept the Terms and Conditions, and submit the order by pressing the "Order and Pay" button.
      1. Submitting the Electronic Order Form by the Customer constitutes a binding declaration of intent to conclude a Distance Sales Contract in accordance with these Terms and Conditions.
      2. A Distance Sales Contract is deemed concluded upon acceptance of the Electronic Order Form by the Seller, confirmed by displaying a message to the Buyer confirming acceptance of the order and providing its number.
      3. After concluding the Distance Sales Contract, the Customer receives an order confirmation via email containing: order receipt confirmation and final confirmation of all essential Order elements as well as general conditions of the concluded Distance Sales Contract (Online Store Terms and Conditions with Annexes 1 and 2), Seller data, Seller's liability for service quality, post-sale services provided by the Seller, and the procedure and effects of withdrawal from the contract. Instruction on the procedure and effects of withdrawal is contained in Annex No. 1.
      4. Until the Seller begins processing the order:
        1. The Customer can modify their order using a technical solution available on the Electronic Order Form page and by completing the entire order path again. Order modification takes place by placing a new order which replaces the previous one. Any payment made by the Customer is applied toward the new order, and in case of overpayment, it is refunded to the bank account from which it was made.
        2. The Customer can cancel their order by selecting the "cancel order" option available on the Electronic Order Form page.
      5. In the event of order cancellation by the Customer, the Seller refunds received payments within 3 business days. Refunds will be made using the same payment method used by the Customer.
      6. Order fulfillment begins after the Online Store receives confirmation of successful payment processing from the Payment Entity. For cash-on-delivery orders, order fulfillment begins after verifying the order's presence in the system.
  4. Payment
    1. The Online Store offers prepayment, cash-on-delivery, and payment to account after delivery. Deferred payment options are available upon individual agreement with the Seller.
    2. Payment for Goods can be made using the method selected at the time of order placement on the Electronic Order Form.
    3. Currently available prepayment methods in the Online Store are listed at https://tuyapolska.pl/checkout/.
    4. The entity providing online quick transfer payment services is Shopify Payments.
    5. Supported payment cards are Visa and MasterCard.
    6. Order execution begins after the Online Store receives confirmation of successful payment processing from the Payment Entity.
  5. Delivery
    1. On the Electronic Order Form, the Customer selects the delivery method by checking their choice. The Seller reserves the right to change the delivery method selected by the Customer without additional costs to the Customer.
    2. In the event that the Goods are not picked up by the Customer, resulting in the return of Goods to the Seller, the Seller may withdraw from the sales contract. Withdrawal occurs by sending an email declaration to the Customer.
    3. In the situation specified in point 2, the Seller is obliged to promptly refund the Customer for the payment received for the purchased Goods.

  6. Contract Withdrawal - Electronic Return Form
    1. A Buyer who is a Consumer concluding a Distance Sales Contract may withdraw from it within 14 days without giving any reason. In the event of withdrawal from a Distance Sales Contract, the contract is considered null and void.
    2. The right to withdraw from the contract under terms defined in Chapters 6 and 7 of these Terms and Conditions also applies to a sole proprietor purchasing for non-professional purposes.
    3. The Seller will verify the entitlement of the person indicated in point 2 to submit a withdrawal statement. Verification is conducted by checking whether the concluded contract lacks professional character for that person - evaluated in particular through the analysis of PKD codes listed in the Central Register and Information on Economic Activity.
    4. If it is determined that the purchase of Goods in the Online Store by a sole proprietor was of a professional nature, the Seller immediately, i.e. no later than within 3 business days from receiving the declaration of withdrawal, informs the declarant that due to the professional nature of the purchase, the right of withdrawal does not apply, and therefore the declaration of withdrawal produces no legal effect. If physical Goods were returned alongside the withdrawal declaration, the Goods will be returned at the expense of the declarant to the address data previously provided in the Order. The Seller's response will be provided using the same method used by the declarant.
    5. In the event of withdrawal, the Consumer bears only the direct costs of returning the Goods.
    6. The Consumer's statement must unequivocally express their intent to withdraw from the contract; in particular, the Consumer may:
      1. withdraw from the contract using the withdrawal form.
      2. The Seller will promptly confirm receipt of the withdrawal statement submitted as indicated in sub-points 1 and 2 on a Durable Medium.
    7. Sending the statement before the deadline is sufficient to meet the withdrawal period.
    8. The withdrawal period begins:
      1. for contracts where the Seller delivers an item and is obliged to transfer its ownership - from the moment the Consumer or a third party indicated by them (other than the carrier) takes physical possession of the Goods, and in the case of a contract that:
        1. includes multiple goods delivered separately, in lots or parts - from taking possession of the last item, lot, or part;
        2. consists of regular delivery of goods over a specified period - from taking possession of the first item;
      2. for other contracts - from the date of contract conclusion.
    9. The right of withdrawal from a Distance Sales Contract does not apply to contracts specified in Art. 38 of the Act of May 30, 2014 on Consumer Rights, including Contracts:
      1. where the price or remuneration depends on financial market fluctuations beyond the trader's control occurring before the withdrawal deadline;
      2. where the subject of performance is a non-prefabricated item, manufactured according to Customer specifications or serving personalized needs;
      3. where the subject is goods delivered in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons if opened after delivery;
      4. where the subject is sound or visual recordings or computer software delivered in sealed packaging if opened after delivery;
      5. for supplying digital content and electronic licenses not saved on a tangible medium, if performance began with the Consumer's explicit consent before the withdrawal deadline and after being informed by the trader about the loss of the right of withdrawal;
      6. where the subject is goods subject to rapid deterioration or having a short shelf life, and goods which after delivery, by their nature, become inseparably mixed with other items;
      7. for delivering newspapers, periodicals, or magazines, except subscription contracts;
      8. concluded via public auction;
      9. for accommodation services other than for residential purposes, goods transport, car rental, catering, or leisure, entertainment, sports, or cultural event services, if a specific date or period of performance is provided in the contract;
      10. where the subject is alcoholic beverages whose price was agreed upon contract conclusion, delivery of which can only take place after 30 days, and whose value depends on market fluctuations beyond the trader's control;
      11. BUYERS OTHER THAN PRIVILEGED BUYERS

        • In the event of a product defect, a Buyer other than a Privileged Buyer has the option to claim defective goods under statutory warranty regulated in the Civil Code.
        • Towards a Buyer other than a Privileged Buyer, the Seller is liable under statutory warranty if a physical defect is discovered before two years elapse from delivery of the goods to the Buyer.
        • Pursuant to the Civil Code, a Buyer who is a business entity other than a Privileged Business Entity loses statutory warranty rights if they did not inspect the goods in time and manner customary for such goods and did not immediately notify the Seller of the defect, or in cases where the defect came to light later - if they did not notify the Seller immediately after discovery. Sending notice of defect before deadline expiry is sufficient.
        • Using statutory warranty, a Buyer other than a Privileged Buyer may, under Civil Code terms:
        • submit a price reduction declaration,
        • in case of a material defect - submit a contract withdrawal declaration,
        • demand replacement of goods with defect-free ones,
        • demand defect removal.
  7. Effects of Contract Withdrawal for Goods
    1. Within 14 days of receiving the declaration of withdrawal from the sales contract, the Seller shall refund all payments made by the Consumer, including delivery costs corresponding to the cheapest standard delivery method offered by the Seller.
      1. Refunds will be executed using the same payment method used by the Consumer.
      2. If the Consumer uses the Electronic Return Form to exercise withdrawal rights, funds will be refunded via the selected method to the bank account specified by the Consumer.
    2. Unless the Seller offered to collect the Goods themselves, the Seller may withhold refund payments until receiving the Goods back or receiving proof of return dispatch, whichever occurs first.
    3. The Seller may propose picking up the item from the Consumer. If no such proposal is made, the Consumer should return the item to the Seller (or person authorized by the Seller) immediately, but no later than 14 days from contract withdrawal. Returning the item before deadline expiry is sufficient. Goods returned by the Consumer should be sent to the Seller's registered office address.
    4. The Consumer is liable for any diminished value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics, and functioning.
  8. Complaints
    1. 8.1 The Seller is obliged to deliver Goods free from physical and legal defects and is liable to the Customer for defects under rules defined in the Civil Code.
    2. 8.2 If after ownership transfer the Buyer discovers physical or legal defects, the Buyer may submit a statutory warranty complaint to the Seller:
      1. via the complaint form;
      2. in written form to the Seller's address - ul. Wrocławska 112, 58-100 Świdnica, Poland - or by email to sklep@tuyapolska.pl.
      3. The notification should state the defect, Buyer's demands, and where possible, document the defect and present proof of purchase in the Online Store. The Seller is obliged to respond within 14 days of receipt. Failure to respond within this period implies complaint acceptance. The response will be sent in writing or on a Durable Medium.
      4. Return address for complained goods: DSB Sp. z o. o., ul. Wrocławska 112, 58-100 Świdnica, Poland.
      5. Steps required by the Buyer to submit a complaint, including delivery of complained Goods, are outlined in stages on the Electronic Complaint Form. If another method is used, the Seller will inform the Buyer of further steps accordingly.
      6. If the Seller deems the complaint justified: replacement, repair, and shipping costs associated with the complaint are borne by the Seller.
      7. The Seller will verify whether a complaint submitted by a sole proprietor purchasing for non-professional purposes is non-professional in nature through PKD codes in the Central Register.
      8. If a dispute resulting from a Consumer complaint remains unresolved, the Seller will provide a written or durable medium statement regarding:
        1. intent to request out-of-court consumer dispute resolution or consent to participate, or
        2. refusal to participate in out-of-court consumer dispute resolution.
  9. Reviews
    1. Within a specified period after order fulfillment, Customers with an Account may receive an email invitation to rate the order service and individual products. Ratings are voluntary and free of charge via an external link, limited to once per order.
    2. Ratings can range from 1 to 5 stars accompanied by a text review up to 65,535 characters, signed automatically with the Customer's account name.
    3. The Seller does not verify or control Review content. The Buyer bears sole responsibility for their statements. The Seller reserves the right to block Reviews in whole or part under applicable legal regulations and these Terms.
    4. Posting untrue, misleading, vulgar, aggressive, offensive, or immoral content is prohibited, as is unlawful content violating third-party rights or unfair competition laws.
    5. Customers agree not to post promotional links, advertisements, or third-party personal data.
    6. Customers bear full liability for edited and posted statements, particularly regarding rights violations.
    7. Upon Customer request, review text may be hidden from other users, though star ratings remain counted toward overall Store and Product scores.
  10. Intellectual Property
    1. The Customer declares they hold no copyright or related rights to posted Reviews beyond normal Online Store usage permitted under these Terms. Unauthorized recording, reproduction, sharing, or distribution is prohibited unless allowed by law.
    2. Interfering with store content, structure, design, graphics, or code mechanism is strictly prohibited.
    3. By posting Reviews considered works under Copyright Law, the Customer grants the Seller a non-exclusive, royalty-free, perpetual, worldwide license to use, sublicense, publicly display, and distribute reviews online across all known exploitation fields, including print, digital media, advertising, and marketing.
    4. Account or Review deletion does not affect the validity of the granted license.
  11. Final Provisions
    1. These Terms of Use are effective as of July 16, 2026.
    2. If any provision is declared invalid by a competent authority or court, remaining provisions remain binding.
    3. Polish law applies to dispute resolutions, handled by competent local general courts. Consumer Customers can utilize out-of-court complaint handling via www.uokik.gov.pl upon mutual consent.
    4. Pursuant to Regulation (EU) No 524/2013, the European ODR platform for online dispute resolution is accessible at https://ec.europa.eu/consumers/odr.
